Why is insurance blaming my wife for a South Burlington icy parking lot fall?

If you do not push back with proof, the insurer will cut the claim's value or deny it outright by arguing your wife was mostly at fault. In Vermont, that matters because under modified comparative negligence, her compensation is reduced by her share of fault, and she can be barred if she is found more negligent than the property owner.

That does not mean the insurer is right. A South Burlington store, apartment complex, hotel, or plaza can still be liable if it failed to act reasonably after snow, freezing rain, or one of the ice storms that regularly hit Chittenden County. Property owners are expected to inspect, salt, sand, shovel, and warn people about dangerous conditions within a reasonable time.

To prove that, gather evidence showing what the owner knew, when they knew it, and what they failed to do:

  • Photos or video of the exact area, including black ice, poor lighting, missing salt, blocked drains, slush refreezing, or uncleared walkways
  • The time of the fall and the weather history from that day, especially if freezing rain or a thaw-refreeze cycle hit South Burlington
  • An incident report from the business, landlord, or hotel
  • Witness names from anyone who saw the fall or saw the same icy condition earlier
  • Medical records tying the fall to the injury, whether it is a head injury, shoulder separation, or a burn from unsafe hot water on the property
  • Surveillance footage requests sent fast, before the video is erased
  • Maintenance and snow-removal records, including contractor logs, salting schedules, and prior complaints from tenants or customers

If it happened at an apartment, keep texts, emails, and maintenance requests. If it happened at a hotel or store near Williston Road or Dorset Street, ask whether staff had already received complaints that day.

Vermont has no cap on non-economic damages, so pain, limitations, and ongoing symptoms can matter significantly if the injury is serious.
